Tuesday, Oct 27, 2009 @09:53am CDT (Salt Lake City, UT) -- A U.S. District judge has ruled that the public and media will be able to attend a hearing in Salt Lake City on Friday to determine whether documents relating to the alleged kidnapper of Elizabeth Ann Smart should be sealed.
Brian David Mitchell is accused of kidnapping the then 14-year-old Smart from her home on June 5th, 2002. She was discovered nine months later in downtown Salt Lake City with Mitchell and his wife. The judge also said he would reserve the right to close the courtroom if specific information will be prejudice to Mitchell or invade the privacy of sexual abuse victims. After a final November 30th hearing, a judge will decide if Mitchell is fit to stand trial. On October 1st Smart, now 21 years old, gave testimony to start Mitchell's competency hearing process.
