Janesville- A major surprise during James Koepp`s first court appearance Friday.
Even though police have said Koepp is the main suspect in the deaths of a mother and her two children, prosecutors decided not to file murder charges, at least for now.
The 47-year-old Koepp made his first court appearance via a TV monitor.
Rock County District Attorney David O`Leary decided not to file murder charges because he says there`s "insufficient evidence to meet the criminal burden of proof."
He wouldn`t elaborate to reporters after the hearing.
Koepp has been described as the sole suspect in the killings of 38-year-old Danyetta lentz and her two children, 17-year-old Nicole and 14-year-old Scott.
The family and Koepp lived near each other in the Janesville Terrace mobile home park.
Instead, Koepp was in court today for drunking driving and reckless endangerment charges.
According to the criminal complaint, Koepp allegedly told police during his arrest, "I didn`t mean to kill anyone".
He also asked, "Why are you worried about a drunk driving when you are pinning three murders on me".
Sheriff`s police also believe Koepp was at the crime scene when the murders took place and had a personal relationship with one of the victims.
But none of that evidence was presented in court Friday.
Prosecutors say they`re still waiting for a pathological report that could indicate a cause and time of death.
Koepp`s next court appearance is scheduled for later this month.
