Knox County - Convicted killer Nicholas Sheley won't face a second trial after a judges dismisses charges of aggravated battery.

The judge said the 32 year-old suffers from a severe mental illness, which prevents him from preparing his own defense.  Sheley allegedly ripped apart a Knox County Jail chair and threw the legs at a guard.

Sheley still faces a second murder trial.

He's accused of killing 8 people in Illinois and Missouri.  He was found guilty of killing 65 year-old Robert Randall of Galesburg in his first trial.
