Winnebago County Will Uphold Same-Sex Marriage Ban

WINNEBAGO COUNTY - The Winnebago County Clerk's office says they will uphold the state's ban on same-sex marriages.  This comes on the heels of two downstate county clerks wanting to defend the law put on the books when Illinois signed civil unions into law last year.  Last month, Attorney General Lisa Madigan said she won't support the ban citing that it was unconstitutional and Cook County agreed.

 

Mike Wright and Dan Ford, owners of "The Office" a gay bar in Rockford, have been together for over 30 years.  Last year they got a civil union.  The two are happy with their civil union, but it doesn't guarantee them all the rights they'd like to have.

 

"In a civil union you cannot get a partner's social security benefits if they were to pass away," said Wright. "You could not get the IRA of a person who was passing away either."

 

However, Margie Mullins, Winnebago County Clerk, says it's the law.

 

"Our office is here to uphold the law, and our office is here to do what we have been instructed to do," said Mullins. "That is what we're going to do from this point forward."

 

Opinion and law are two different things.  Mullins says she supports what Madigan and Cook County Clerk David Orr are doing in regard to the law, but she's not going to take that step and break the law passed in Springfield last year. 

 

If a same-sex couple were to come into Mullins' office and request a marriage license she would have to respond with this, "We have a civil union.  It's not considered a marriage.  It is a joining of two people, but it's not on the books as marriage," said Mullins.

 

Wright believes the law will change.  He mentioned that it was just over 50 years ago that black and white people couldn't get married.  He says most of the marriage equality problems are truly at the federal level and that's what Wright and Ford would really like to see change.

@trustworthy -- You're entitled to your opinion regarding whether same-gender couples should be denied treatment under the law equal to straight married couples, but it was silly of you to deny that they are, in fact, being denied tangible and important benefits and protections. (And BTW, if you actually knew a few same-gender couples and their families, you'd probably find there actually aren't any significant differences in how they function as a couple or as a family, or in terms of the value they bring to society. You have just defined yourself as being totally close-minded; fortunately most people are open to the possibility that they might have been wrong.)

ADave N. You are comparing same-[censored] with man/woman relationships. There is a huge difference. I am not a supporter of gay rights and I have the freedom to have that opinion. There is no way anyone will convince me that gay marriage is morally right.

@trustworthy -- quite aside from the obvious fact that they are just two of the many reasons, what exactly is wrong with those two reasons?? Do you think it would be OK if black couples were singled out by denying them social security benefits?? Or Jewish couples?? Or Christian couples?? How about we decide that everybody in your family that currently gets health coverage through their spouse's employee health plan suddenly were to be denied those benefits because of their religion?? Would that be OK with you??

@trustworthy -- Same-gender couples want to get married for all the same reasons straight couples do. But in terms of how they are discriminated against by state and federal laws, it is about all the many benefits and protections that are granted to straight married couples but denied same-gender couples ... even in states with civil union laws that supposedly grant them equal status. There are many more than just those two.
