(Los Angeles, CA) -- A Los Angeles judge's decision not to order the use of condoms by actors in the porn industry will be appealed.
The AIDS Healthcare Foundation had filed suit seeking a court order designed to force an order from public health officials.
The AHF said it wanted steps taken to limit sexually transmitted diseases from being spread during the production of pornography in Los Angeles County.
In December, a judge threw the suit out saying the county already has broad discretion in how it overseas public health.
A spotlight was cast on the issue last June when it was discovered an actress working in the adult film industry had tested positive for HIV.
The AHF says it will appeal the December decision to the 2nd District Court of Appeal to, according to a spokesman, "compel the Department of Public Health to fulfill its responsibility to try and control the spread of (disease) in L.A. County."
